Terms of service
These terms cover the UpDog iOS app and this website. By using UpDog you agree to them.
1. What UpDog is
UpDog is an app for logging what your puppy does during the day, setting reminders, and sharing that with the other people in your household. It runs on your phone and syncs your data if you are connected.
2. Your account
You are signed in anonymously by default, with no email address or password. You may add an email address so that you can restore your data on another device. If you do, keep access to that mailbox secure: anybody who can read the one-time codes sent to it can sign in as you.
You can delete your account from inside the app at any time. That deletes the data synced with it.
3. Households
You can invite other people into a household so you all log against the same puppy. Anyone you invite can see and change that household's activities, pets, and reminders. Only invite people you mean to share with. Removing someone from a household stops their access going forward.
4. Acceptable use
You agree not to:
- use UpDog to break the law
- try to reach data belonging to other people, or interfere with the service or the systems it runs on
- probe, scrape, or overload the service, or work around any limit on it
- resell, rent out, or redistribute the app or the service
5. What you put into the app
Your puppy's name, your notes, and everything else you enter stay yours. You give us permission to store it, sync it, and show it back to you and to the people in your household, which is what makes the app work. We do not use it for anything else. See the privacy policy for what is stored and who receives it.
6. UpDog is not veterinary advice
UpDog is a logbook. It records what you tell it. It does not diagnose anything and nothing in it is veterinary advice. If you are worried about your puppy's health, talk to a vet. Do not delay doing so because of something the app did or did not show you.
7. Cost
Version 1.0 of UpDog is free. There is no subscription and there are no in-app purchases. If paid features are added later, the terms covering them will be added as a section here, and you will be told what costs money before you are charged for anything.
8. The service can change
We may add, change, or remove features, and the app depends on outside providers for sync and sign-in, so it will occasionally be unavailable. We do not promise the service will be continuous or error free.
9. No warranty
UpDog is provided as it is, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, secure, or free of errors, or that data will never be lost. Keep your own copy of anything you cannot afford to lose.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or harm to an animal, arising out of your use of UpDog. Where liability cannot be excluded, it is limited to the amount you have paid us for UpDog in the twelve months before the claim, which for version 1.0 is nothing.
Some jurisdictions do not allow these exclusions, in which case they apply to you only as far as the law allows. Nothing here limits liability for death or personal injury caused by negligence, or for fraud.
11. Ending it
You can stop using UpDog at any time and delete your account in the app. We may suspend or end access to the service if it is being used in a way that breaks section 4 or puts other people at risk.
12. Changes to these terms
If these terms change, this page changes and the date at the top is updated with it. Continuing to use UpDog after that means you accept the new version.
13. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute arising out of these terms or out of your use of UpDog goes to the state or federal courts located in Alameda County, California, and both you and we agree to those courts hearing it.
If the law where you live gives you the right to bring a claim locally, or gives you consumer protections that cannot be signed away, this section does not take those away from you.
